Vermont Lead Laws require that owners of rental and child care facility properties file an annual compliance statement with the Department of Health indicating that all regulatory requirements have been satisfied.

During the COVID-19 pandemic response, it was challenging for property owners to access rental properties to conduct the evaluation needed to submit annual compliance statements to the Health Department. Additionally, the Health Department program staff priorities were in support of the emergency response and less outreach was conducted to increase compliance.

What Works

Thirty to sixty days before filing due dates a reminder post card or and online systems generated email is sent to all pre-1978 residential rental or licensed child care facility owners who have previously filed an EMP compliance statement. When filings are beyond 30 days past due, another reminder post card or email is sent out. These reminders are somewhat effective in reminding those owners who have forgotten to file, but if they still do not file, they may be subject to civil complaint penalties (tickets) ranging from $50 to $250. Sixty days past due filings will result in a civil complaint ticket for non-compliance of the law.

Action Plan

Help to notify existing, prospective and non-compliant owners to file annually using our online system. Non-filer owners are being identified using numerous avenues. This Department is continually identifying ways to raise awareness by using outreach materials.
